Terms of Service

Welcome to HeyThere. These Terms of Service (“Terms”) govern your use of the HeyThere website, iOS application, and related services (collectively, the “Service”), operated by Peak Product Group LLC, an Oregon limited liability company (“we”, “us”). By creating an account or using the Service, you agree to these Terms.
1. Eligibility
You must be at least 16 years old to use HeyThere. By using the Service you represent that the information you provide is accurate and that you have the right to grant us access to any connected accounts (such as Google or Apple).
2. Your account
You are responsible for maintaining the security of your account and for all activity that occurs under it. Notify us immediately at chris@peakproductgroup.com if you believe your account has been compromised.
3. Acceptable use
You agree not to:
- Use the Service to send spam, harassment, or unlawful content.
- Attempt to reverse engineer, scrape, or interfere with the Service or the infrastructure it runs on.
- Impersonate another person or misrepresent your affiliation with any organization.
- Use the Service for bulk outbound messaging at a scale that violates the terms of your connected email provider.
- Violate any applicable law, regulation, or third-party right.
You are responsible for the content of messages you send through the Service. HeyThere drafts outreach suggestions using AI; you are the sender and are responsible for reviewing and approving every message before it is delivered.
4. Connected third-party accounts
Features like email sending, reply detection, and contact discovery rely on third parties (including Google, Nylas, Anthropic, Exa, Hunter.io, Apify, Stripe, Expo, and Supabase). Your use of those features is also subject to those providers’ terms. We are not responsible for their availability or changes to their services.
5. AI-generated content
The Service uses large language models to generate recommendations, rationales, and email drafts. AI output may be inaccurate, incomplete, or inappropriate for your situation. You are solely responsible for reviewing and editing any content before sending it, and for how you use any recommendations.
6. Subscriptions and payments
Paid plans, if offered, are billed through Stripe and are described at the point of purchase. Subscriptions renew automatically until cancelled. You can cancel at any time; cancellation stops future renewals but does not entitle you to a refund of the current period unless required by law.
7. Intellectual property
HeyThere and all associated content, trademarks, and software are owned by us or our licensors. We grant you a limited, non-exclusive, non-transferable license to use the Service for your personal, non-commercial networking activities. You retain ownership of the content you submit (such as your resume or career goals); you grant us the license needed to operate the Service on your behalf.
8. Termination
You may delete your account at any time from the Settings screen. We may suspend or terminate your access if you violate these Terms or if we’re required to do so by law. On termination, your data is handled as described in our Privacy Policy.
9. Disclaimers
The Service is provided “as is” and “as available.” We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee any employment or networking outcome.
10. Limitation of liability
To the fullest extent permitted by law, HeyThere and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenues, arising out of or related to your use of the Service. Our total liability for any claim related to the Service is limited to the greater of the amounts you paid us in the 12 months preceding the claim or USD $100.
11. Changes to these Terms
We may update these Terms from time to time. Material changes will be announced in-app or by email. Continued use of the Service after an update constitutes acceptance of the revised Terms.
12. Governing law
These Terms are governed by the laws of the State of Oregon, United States, without regard to its conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in Multnomah County, Oregon.
